Finance OS Product Terms

These terms govern your subscription to Finance OS. They are separate from the Terms of Use that govern reading this website. Our refund position is set out in full in the Refund and Cancellation Policy.

Who you are contracting with

Finance OS is supplied by Tumai Meroiti (ABN 75 527 278 804) trading as Finance OS ("we", "us", "our"). You can contact us at hello@financeos.au or by mail at 259 Normanby Road, South Melbourne, Victoria 3205.

Your rights under the Australian Consumer Law

Read this first. Everything else in these terms sits on top of it.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law which cannot lawfully be excluded, restricted or modified.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to have our services rendered with due care and skill and fit for the purpose for which they are supplied. You are entitled to a remedy if a service fails to meet a consumer guarantee, and to compensation for any other reasonably foreseeable loss or damage.

The commercial terms set out below apply in addition to, and do not limit, those rights.

What Finance OS is

Finance OS is a broker operating system: a white-labelled platform configured for Australian mortgage broking, including funnels, automated follow-up, unified inbox and post-settlement nurture, with done-for-you setup by our team on the tiers that include it.

It is a marketing and client-communication system. It is not a lodgement platform and does not replace your aggregator's systems. It is built on a third-party platform, and that platform's limits apply to it.

We do not provide financial product advice or credit assistance, and Finance OS is not a tool for providing either. You remain responsible for your own licensing, compliance and record-keeping obligations.

All amounts are in Australian dollars and include GST where applicable. Subscription fees are billed monthly in advance and renew automatically until cancelled. Annual billing is available and is charged at ten months for twelve. The current schedule is always published at our pricing page.

Metered usage is charged on top of the subscription. SMS, phone calls and some AI features are passed through at cost as you use them. They are not included in the subscription fee and are not capped by it.

We will give you at least 30 days' written notice before any change to your subscription fee. If you do not accept the change, you may cancel before it takes effect and will not be charged the new amount.

Cancellation

You may cancel at any time by contacting us at hello@financeos.au.

Cancellation takes effect at the end of your current billing period. You keep access until then. We do not charge a cancellation fee and we do not require a minimum term.

We may suspend or cancel your subscription if you materially breach these terms, if payment fails and is not remedied within 7 days of us telling you, or on 30 days' written notice for any other reason. If we cancel other than for your breach, we refund the unused portion of any period you have paid for.

Refunds

Section 2 applies to everything in this section. If a service we supply fails to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law regardless of the commercial terms below.

Onboarding fee. The onboarding fee covers work we perform for you specifically — configuration, installation and onboarding. Once that work has commenced, it is not refundable as a matter of commercial terms. If it has not commenced, we refund it in full on request, and we tell you before it commences so the point at which this changes is never a surprise.

Subscription fees. Subscription fees for the current billing period are not refunded on cancellation as a matter of commercial terms, and we do not pro-rate part-months. You retain access for the remainder of the period you have paid for.

How to ask. Email hello@financeos.au with your account details and what went wrong. We will respond within 5 business days. Where a refund is due, we process it to the original payment method within 10 business days. The full position is in the Refund and Cancellation Policy.

Your data and your clients’ data

You own your data and your clients’ data. We do not claim ownership of it and we do not sell it.

We host and process it for you in order to provide the service. Your clients' records are held on the infrastructure of the third-party platform Finance OS is built on, which is located outside Australia, in the United States. By using Finance OS you consent to that storage and processing occurring overseas.

You are responsible for your own obligations to your clients in respect of their personal information, including under the Privacy Act 1988 (Cth) where it applies to you. We will assist you to meet them.

On cancellation you may export your data. We will retain it for 30 days after cancellation so you can do so, after which we may delete it.

Acceptable use

You must not use Finance OS to send messages that breach the Spam Act 2003 (Cth), to make calls that breach the Do Not Call Register Act 2006 (Cth), to store data you have no right to hold, or to resell or sublicense the platform without our written agreement. The full rules are in our Acceptable Use Policy.

You are the sender of the messages you send through the platform. You are responsible for holding the consents those messages require, for identifying yourself correctly in them, and for honouring unsubscribe requests.

Availability

We aim to keep the service available at all times but do not promise uninterrupted availability. The platform Finance OS is built on is operated by a third party and its availability is outside our control. We will tell you about planned maintenance where we reasonably can.

Liability

Section 2 applies to this section and prevails over it.

Subject to section 2, and to the extent permitted by law, our total liability to you in connection with the service in any 12-month period is limited to the amount you paid us in the 12 months before the claim arose.

Subject to section 2, neither of us is liable to the other for indirect or consequential loss, or for loss of profits, revenue or data, however arising.

Changes to these terms

We may change these terms. We will give you at least 30 days' written notice of any change that materially affects you. If you do not accept the change you may cancel before it takes effect, and we will refund the unused portion of any period you have paid for.

Governing law

These terms are governed by the laws of Victoria, Australia. Both of us submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.

Complaints

If something has gone wrong, contact us at hello@financeos.au and we will try to resolve it with you directly. If we cannot, you may be able to take the matter to the Australian Competition and Consumer Commission at accc.gov.au, or your state consumer affairs body.
